Responsibility

Contracting Party, Conclusion of the Contract

The sales contract is concluded with ELFCAM SARL. By placing an order on our website, we make a binding offer to conclude the purchase contract for these items. You can add our products to the shopping cart without obligation and correct your entries at any time before sending your order using the help and hints presented in the ordering process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. After submitting the order, you will immediately receive a confirmation email. You may correct order information when it is not entered into the shipping process by notifying your account manager in advance in writing. However, orders containing personalized items or other special conditions cannot be modified once they reach "processing" status. If your order has to be shipped by an affiliate of ELFCAM due to insufficient stock at ELFCAM SARL or for other reasons, the contracting party on our side under these articles will automatically be changed to the corresponding affiliate of ELFCAM , the actual sender and the invoice issuer. Terms of Delivery

ELFCAM offers delivery options such as Fedex, DHL, Chronopost, Colissimo. Please note that orders qualifying as Free Delivery are shipped by Chronopost or Colissimo in French territory. Goods damaged during transport must be notified by the customer to the seller. And if any delay is caused by the logistics company, please notify your account manager as soon as possible.

We can guide you on repair procedures. But ELFCAM will not be responsible for any losses. In order for each customer to receive the items as quickly as possible, your order can be shipped in several packages at no additional cost to ELFCAM.

For air or sea transport, customers must be informed whether the goods must be collected at the airport or port. If customers can collect the goods from the airport or seaport, it is necessary to know the documents to prepare and the fees to pay. If customers cannot collect the merchandise, the home delivery service and fees must be negotiated in advance with the account managers.

Title Reserves

Each item delivered remains the property of ELFCAM until payment has been made in full. For entrepreneurs, the following provisions additionally apply:

We reserve title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved merchandise in the ordinary course of business; All claims arising from this resale are assigned to us in advance – regardless of any combination or mixing of the goods subject to retention of title with a new item – for the invoice amount, and we accept this assignment. You remain entitled to collect claims, but we may also collect them ourselves if you fail to meet your payment obligations.

Intellectual Property Rights and Confidentiality

If a third party were to assert rights against the customer in the event of infringement of industrial property rights or copyrights relating to the delivered products, the customer is obliged to notify them immediately. Where applicable with the support of the client, ELFCAM will have the right, but at its own expense, to conduct any negotiations with a view to a settlement or any resulting legal proceedings.


If the products supplied have been constructed in accordance with the design or instructions of the customer, the latter will indemnify ELFCAM against all claims, liabilities, charges and costs asserted by third parties due to infringement of patents, trademarks or samples. A reasonable advance on the costs of the legal proceedings will be granted to ELFCAM.


ELFCAM is obliged to use any knowledge of company secrets and information that can be classified as confidential, acquired within the framework of the contractual relationship only for the implementation of this contract. Both parties must treat all documents and information they receive during the execution of a contract as confidential and as long as such documents and information are not generally known.


These obligations will also remain in force after the end of the contract and will also be imposed on third parties in the event of authorized transfer of documents and information.

Right to retract

You have the right to cancel a contract within fourteen days. The cancellation period is fourteen days from the date on which you or a designated third party who is not the carrier received the goods.

The right of withdrawal is not applicable to personalized items in the order or an individual request.

Consequences of Cancellation

If you cancel this contract, you will be responsible for the cost of returning the goods. We will reimburse you for all costs (except for additional costs resulting from choosing a different delivery instead of the free standard delivery that we offer.) no later than fourteen days from the date on which notification of your revocation for this contract has reached us. Unless you agree otherwise, we will use the same payment method that you used in the original transaction for this reimbursement; we may refuse the refund until we have received the returned goods.

Export and Import Licenses

The products and technical know-how provided by ELFCAM are intended to be used and remain in the country of delivery agreed with the customer.

The re-export of contract products – individually or integrated into a system – may require the customer to obtain a license and must be subject to the foreign trade regulations of the French Republic and the European Union or the other country of delivery agreed with the customer.

The customer must obtain information about these regulations himself in accordance with the provisions. Regardless of whether the customer specifies the final destination of the supplied contract products, he himself is responsible for obtaining all necessary licenses from the competent foreign trade authorities before exporting these products.

Any further delivery of contract products to third parties by the customer, with or without the knowledge of ELFCAM, requires at the same time the transfer of the conditions of the export license. The customer is responsible towards ELFCAM for compliance with these conditions.

Conflict Resolution

The European Commission provides an online dispute resolution (OS) platform which you can find by clicking on this link http://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
